One of the deepest ideological divides in contemporary epistemology concerns the relative importance of belief versus credence. A prominent consideration in favor of credence-based epistemology is the ease with which it appears to account for rational action. In contrast, cases with risky payoff structures threaten to break the link between rational belief and rational action. This threat poses a challenge to traditional epistemology, which maintains the theoretical prominence of belief. The core problem, we suggest, is that belief may not be (...) enough to register all aspects of a subject’s epistemic position with respect to any given proposition. We claim this problem can be solved by introducing other doxastic attitudes—genuine representations—that differ in strength from belief. The resulting alternative picture, a kind of doxastic states pluralism, retains the central features of traditional epistemology—most saliently, an emphasis on truth as a kind of objective accuracy—while adequately accounting for rational action. According to robust virtue epistemology , knowledge is type-identical with a particular species of cognitive achievement. The identification itself is subject to some criticism on the grounds that it fails to account for the anti-luck features of knowledge. Although critics have largely focused on environmental luck, the fundamental philosophical problem facing RVE is that it is not clear why it should be a distinctive feature of cognitive abilities that they ordinarily produce beliefs in a way that is safe. We propose (...) a novel way to resolve this problem. Key to our proposal will be an appreciation of different representational states beholden to truth. We suggest these different representational states are distinguished by how, in the proper governance of these states, the twin goods of attaining truth and avoiding error are weighted. Moreover, we explain how varieties of representational states line up with varieties of cognitive achievement such that knowledge, cum cognitive achievement, must be safe because of the kind of attempt at success that belief is—namely, an attempt that places the premium it does on avoiding error. We develop a novel challenge to pragmatic encroachment. The significance of belief-desire psychology requires treating questions about what to believe as importantly prior to questions about what to do; pragmatic encroachment undermines that priority, and therefore undermines the significance of belief-desire psychology. This, we argue, is a higher cost than has been recognized by epistemologists considering embracing pragmatic encroachment.

ABSTRACT: We argue that the so-called ‘Primary’ and ‘Secondary’ Value Problems for knowledge are more easily solved than is widely appreciated. Pritchard, for instance, has suggested that only virtue-theoretic accounts have any hopes of adequately addressing these problems. By contrast, we argue that accounts of knowledge that are sensitive to the Gettier problem are able to overcome these challenges. To first approximation, the Primary Value Problem is a problem of understanding how the property of being knowledge confers more epistemic value (...) on a belief than the property of being true. The Secondary Value is a problem of understanding how, for instance, property of being knowledge confers more epistemic value on a belief than the property of being jointly true and justified. We argue that attending to the fact that beliefs are ongoing states reveals that there is no difficulty in appreciating how knowledge might ordinarily have more epistemic value than mere true belief or mere justified true belief. We also explore in what ways ordinary cases of knowledge might be of distinctive epistemic value. In the end, our proposal resembles the original Platonic suggestion in the Meno that knowledge is valuable because knowledge is somehow tied to the good of truth. (shrink)

We challenge a line of thinking at the fore of recent work on epistemic value: the line (suggested by Kvanvig in The value of knowledge and the pursuit of understanding, 2003 and others) that if the value of knowledge is “swamped” by the value of mere true belief, then we have good reason to doubt its theoretical importance in epistemology. We offer a value-driven argument for the theoretical importance of knowledge—one that stands even if the value of knowledge is “swamped” (...) by the value of true belief. Specifically, we contend that even if knowledge itself has no special epistemic value, its relationship to other items of value—cognitive abilities—gives ample reason to locate the concept at the very core of epistemology. COPII coated vesicles bud from an ER domain termed the transitional ER (tER), but the mechanism that clusters COPII vesicles at tER sites is unknown. tER sites are closely associated with early Golgi or pre‐Golgi structures, suggesting that the clustering of nascent COPII vesicles could be achieved by tethering to adjacent membranes. This model challenges the prevailing view that COPII vesicles are clustered by a scaffolding protein at the ER surface. Although Sec16 was proposed to serve as such a scaffolding (...) protein, recent data suggest that rather than organizing COPII into higher‐order structures, Sec16 acts at the level of individual COPII vesicles to regulate COPII turnover. A plausible synthesis is that tER sites are created by tethering to Golgi membranes and are regulated by Sec16. Meanwhile, the COPII vesicles that bud from tER sites are thought to nucleate new Golgi cisternae. Thus, an integrated self‐organization process may generate tER‐Golgi units. (shrink)

Wie andere aufgeschlossene Fachvertreter seiner Generation hat der kanadische Jesuit Bernard Lonergan (1904–1984) dazu beigetragen, die katholische Theologie umfassend zu erneuern. Angesichts der offenkundigen Grenzen der Neuscholastik, die sich im Laufe des 19. Jahrhunderts als das Modell durchgesetzt hatte, suchte er schon früh nach einer Alternative. Bei aller Skepsis gegenüber dem herrschenden Thomismus schätzte er Thomas von Aquin in hohem Maß. Das betraf insbesondere dessen Bemühen, die damals aktuellen wissenschaftlichen und methodischen Erkenntnisse einzubeziehen. Lonergan wollte dies ebenso tun. Es ging (...) ihm darum, der katholischen Theologie eine neue Richtung zu geben, also von der Neuscholastik abzurücken. Denn diese berücksichtigte weder das erkennende Subjekt noch das zu erkennende Objekt hinreichend. (shrink)

Wenn Plato weise ist, dann gibt es mindestens dreierlei: Plato, die Weisheit und Platos Weisheit. Dies sind beispielhafte Vertreter von drei ontologischen Kategorien (Substanz, universelle Eigenschaft, partikularisierte Eigenschaft), die grundlegend für unsere Weltorientierung sind. Als Beitrag zur deskriptiven Metaphysik im Sinne P.F. Strawsons entwickelt Schnieder eine Konzeption dieser Kategorien und ihres Zusammenhangs. Er expliziert und verteidigt klassische Ideen der Philosophiegeschichte mit analytischer Methodik und unter Einbezug von sprachphilosophischen, modallogischen und mereologischen Erwägungen. Unter anderem argumentiert er, dass Substanzen aufgrund ihrer existentiellen (...) Unabhängigkeit eine ontologische Sonderstellung zukommt. Indem es auf das erneut erwachsene Interesse an der Metaphysik reagiert und Grundzüge der aktuellen Debatten voraussetzungsarm erläutert, kann das Buch auch als allgemeine kritische Einführung in das Thema dienen. Gerade weil das Bestehen auf Rangordnungen in der heutigen Gesellschaft anstößig und fremd wirkt, ist es lohnenswert, sich ihnen mit Nietzsche neu zu stellen, der sie als sein Problem bezeichnete. Er richtet sie gezielt gegen die Gleichheit, von der er befürchtet, ihr Anspruch auf Universalität verunmögliche Individualität, Anders-Sein und damit auch alle Größe. Den moralischen Wert der Gleichheit kritisieren heißt nicht, sich von demokratischen Grundprinzipien oder Errungenschaften zu verabschieden. Geklärte Rangverhältnisse reduzieren Komplexität, vereinfachen die Kommunikation, machen Verhalten erwartbar und vereinfachen (...) so die Orientierung. So könnte gerade in den modernen Ausprägungen der Demokratie ein offenerer Umgang mit Rangordnungen zu ihrer Stärkung beitragen. Die Nietzsche-Forschung hat eine Beschäftigung mit dem Begriff bisher weitgehend vermieden. Alberts schließt diese Forschungslücke. Er geht persönlichen, philologischen und philosophischen Anhaltspunkten für Nietzsches Denken nach und untersucht die Perspektiven, die dabei auf verschiedenste Lebensbereiche wie Natur, Religion, Moral, Wissenschaft und Interindividualität eröffnet werden. The idea that thought and language can be clarified through logical methods seems problematic because, while thought and language are not always exact, logic (by its very nature) must be. According to Kuusela, ideal (ILP, represented by Frege and Russell) and ordinary language philosophy (OLP, represented by Strawson) offer opposed solutions to this problem, and Wittgenstein combines the advantages of both. I argue that, given Kuusela’s characterisation of OLP, Strawson was not an OLP’er. I suggest that, instead of seeing ILP (...) and OLP as opposed to one another, it is better to regard OLP as an extension of ILP. (shrink)

Seit Mitte des 19. Jahrhunderts hat die historisch-materialistische Gesellschaftstheorie wichtige Beitrage zur Rolle des Staates geleistet. Insbesondere seit den 1970er Jahren fragte eine Stromung, die sich zum "westlichen Marxismus" zahlte: Warum nimmt politische Herrschaft in burgerlich-kapitalistischen Gesellschaften die spezifische Form des Staates an? Wie transformiert sich der Staat historisch in enger Verbindung mit gesellschaftlichen Veranderungen? Joachim Hirsch ist ein herausragender Vertreter dieses theoretischen Ansatzes, der die Frage nach der Staatsform ins Zentrum gestellt hat. Er hat Begriffe wie "Sicherheitsstaat", "nationaler Wettbewerbsstaat" (...) und "Internationalisierung des Staates" gepragt und die materialistische Staatstheorie mit der Hegemonietheorie Antonio Gramscis und der Regulationstheorie produktiv verknupft. Wichtige politische Kritiken und Perspektiven verdichten sich in Hirschs Konzepten wie "radikaler Reformismus" und "soziale Infrastruktur". (shrink)

Dem Scheiternden bleibt zumindest der Nachruhm: Hat er nicht die Zukunft herausgefordert und sich nicht passiv in sein Schicksal ergeben? Eingegangene Risiken werden jedoch erst im nachträglichen Erzählen zum Wagnis. Was die einen als Wagnis preisen, mag von anderen als Fehler, Übermut, Hybris, ja Verbrechen gesehen werden.

Este trabajo explora una línea posible del diálogo entre Walter Benjamin y Hannah Arendt mediante la presentación de algunas intermitencias entre dos figuras relevantes de su pensamiento sobre la historia, la figura que Benjamin determina en su abordaje del Angelus Novus pintado por Paul Klee, y la figura de Er en los términos en que Arendt la elabora a partir de una parábola kafkiana. Retomamos ambas figuras con el objetivo de mostrar en ellas el intento filosófico de organizar (...) un pensamiento crítico que resista la esclerosis del concepto moderno y progresivo de historia: en un contexto en que el pasado pareciera diluirse en la impotencia de su presencia y el futuro se presenta como reproducción apocalíptica del desastre, sostenemos que Benjamin y Arendt convocan al Angelus Novus y al Er kafkiano como imágenes capaces de dislocar el anquilosamiento de la crítica y el flujo epistemológico implicado en la crisis moderna de la experiencia. Die Schriften Walter Benjamins stellen ein unvergleichlich aufschlussreiches Repertoire für das Studium von Kritik bereit. Sie zeigen, dass sich Kritik, sei es die der Gesellschaft, des Rechts oder der Kunst, nicht in einem Urteil nach etablierten Kriterien erschöpft. Benjamin erzielt kritische Effekte mit Hilfe von unerwarteten Zusammenstellungen oder genealogischen Rekonstruktionen, die den geläufigen Kriterien der Beurteilung nicht einfach folgen, und gerade dadurch die Eigentümlichkeiten der betrachteten Gegenstände unterscheiden und erkennen lassen. Kritik löst dabei eine Krise der habitualisierten Denkweisen aus (...) und sorgt für eine Wiederbelebung der Empfindsamkeit ihres Rezipienten. In seiner Untersuchung entfaltet Michele Salonia systematisch Benjamins zahlreiche, fragmentarisch gebliebenen Überlegungen zur Kritik, was einen Schlüssel für die Interpretation einzelner Teile seines Œuvres – Jugendschriften, Erkenntnistheorie, politische, Sprach- und Geschichtsphilosophie – sowie der Entwicklung seines Gesamtwerks an die Hand gibt. Zugleich präpariert er dabei einen theoretischen Ertrag heraus, mit dem innovativ in die gegenwärtige philosophische Debatte über die Formen der Kritik eingegriffen werden kann. (shrink)

Die Werke der beiden Philosophen, Soziologen und Asthetiker Walter Benjamin und Georg Simmel sind von der Frage nach der Kultur, genauer nach der Kultur der Moderne durchzogen. Entgegen anderen 'Klassikern' der Kulturwissenschaft konzipierten sie ihre Theorie und Kritik nicht von 'grossen Zusammenhangen' her, sondern erfassten die moderne Kultur in ihrer ganzen phanomenalen Breite, also in den alltaglichen Lebensweisen und der Dingkultur, und gelangten erst in Verdichtung dieser Beobachtungen zu Erkenntnissen des Allgemeinen, Typischen. Die Konfrontation der Schriften der Autoren erlaubt (...) neben einem langst uberfalligen Beitrag zur Rezeptionsgeschichte Simmels zugleich ein vertieftes Verstandnis beider Werke. Simmels Betrachtung der modernen Versachlichung, der Temposteigerung des Lebens sowie der Vielfalt moderner Lebensstile, die er zentral in seiner Philosophie des Geldes vorgenommen hatte, wurde von Benjamin besonders in seinem Passagen-Werk rezipiert und weitergefuhrt - wenn auch angesichts einer radikal veranderten geschichtlichen Wirklichkeit und mit anderen geschichtsphilosophischen Schlussfolgerungen. Beide Autoren teilen dabei einen rein deskriptiven Kulturbegriff, aus dem heraus sie Ansatze zu einer Phanomenologie der Moderne, Kulturphilosophie und Methodologie entwickeln, die sich noch in den heutigen Kulturwissenschaften als 'anschlussfahig' erweisen. In the early twentieth century Walter Benjamin introduced the idea of epochal and ongoing progression in interaction between mind and the built environment. Since early antiquity, the present study suggests, Benjamin’s notion has been manifest in metaphors of gender in city-form, whereby edifices and urban voids have represented masculinity and femininity, respectively. At the onset of interaction between mind and the built environment are prehistoric myths related to the human body and to the sky. During antiquity gender projection (...) can be detected in western perceptions linking natural and built environments, commencing with Plato’s Atlantis and his Myth of Er, and later as a likely import of the Chinese yin-yang mythology. Culminating with the Age of Discovery, alongside advances in experiential awareness of the Earth’s sphericity, respective feminine and masculine earmarks can be detected in early modern perspicacity of the Earth’s southern and northern hemispheres. Our conceptions of natural and built environments inherently continue to contain gender traits. Yet urban voids, as the feminine face of city-form, have been severely understated in the built environment. Through design and configuration of urban voids, allegories of femininity in city-form ought to be celebrated, not discarded. (shrink)

Dorothee Gelhard ergänzt die Untersuchungen zu Walter Benjamin und dem Phänomen des Darstellbaren in Sprache und Bild. Sie zeigt, dass sich Benjamin mit dem Thema der Erfahrung und der Wahrnehmung im Kontext der Malerei tiefgehend auseinandergesetzt hat. Die Beschäftigung mit Kandinsky, dem Blauen Reiter und Chagall hat bei Benjamin zu einem Nachdenken über Farben und Formen geführt. In den Texten über Phantasie und Wahrnehmung verbindet er seine Beobachtungen der modernen Malerei mit den aus den frühen phänomenologischen Studien (...) gewonnenen Erkenntnissen, sodass sich schliesslich der Begriff des "Denkbildes" und des "dialektischen Bildes" immer klarer herausbildet. Diese frühen Überlegungen Benjamins haben sein Passagen-Werk vorbereitet, in dem er das Nachleben der Vergangenheit in der modernen Grossstadt aufspürt und nach dem Verbleib des Bildbewusstseins des Einzelnen in einer immer technischer werdenden Moderne fragt. Kaum ein anderer Denker hat die jüdische Moderne in einem so hohen Maße beeinflusst wie der Philosoph Baruch Spinoza. Als eine intellektuelle Grenzfigur, die nach ihrer Verbannung aus der jüdischen Gemeinde Amsterdams im Jahre 1656 in die christlich-abendländische Geisteswelt eintrat, inspirierte er jene Aufklärer der Haskala, die ein gutes Jahrhundert später nach einem eigenen jüdischen Weg in die europäische Moderne suchten. Diese Denker trafen dabei auf eine nichtjüdische Gelehrtenwelt, in der sich mit dem Namen des niederländischen Philosophen ebenso idealisierende Erwartungen (...) wie irrationale Ängste gegenüber dem in Spinoza identifizierten intellektuellen Idealtypus des Jüdischen verbanden. Somit ist die Geschichte der jüdischen Rezeption Spinozas seit dem Zeitalter der europäischen Aufklärung stets ein Indikator dafür, welchen Stand das wechselhafte Verhältnis zwischen jüdischer und nichtjüdischer Welt gerade erreicht hatte. Im Nachvollzug der Verlaufsformen der jüdischen Spinoza-Rezeption vom 17. bis ins 20. Jahrhundert zeigt die vorliegende Studie, wie sich jüdisches Selbstbild und Fremdzuschreibung immer wieder wechselseitig bedingt haben. (shrink)

Benjamin Libet's celebrated experiments concerning freedom elicited numerous attempts of _philosophical_ repudiation. Ten years ago, however, Judy Trevena and Jeff Miller published a _technical_ objection; they claim to have detected a,,smearing artifact" in Libet's calculations. This rests on a misunderstanding of Libet's methodology. In my reconstruction of Libet's argument, he draws an abductive inference to the best explanation. Now, Trevena's and Miller's objection does indeed lead to alternative explanations of Libet's measurements. These alternatives are _ad hoc_ and extremely improbable. (...) They constitute worse explanations than the explanation offered by Libet. _German_ Benjamin Libets bahnbrechende Experimente zur Willensfreiheit aus den Achtziger Jahren des vorigen Jahrhunderts gehören längst zu den Klassikern der Experimentalkunst. Aus _philosophischer_ Perspektive sind sie oft kritisiert worden; unabhängig davon ist zu Beginn des neuen Jahrtausends ein _technischer_ Einwand gegen Libet prominent geworden, der von Freiheitsfreunden gerne zitiert wird. Er geht auf Judy Trevena und Jeff Miller zurück und besteht in dem Vorwurf, dass Libet mit seiner Berechnung der _gemittelten_ Bereitschaftspotential-Kurven die wahren Verhältnisse verschmiere und dabei aus mathematischen Gründen den Anstiegs-Zeitpunkt des Bereitschaftspotentials künstlich nach vorne verschiebe – das ist der Vorwurf des sog. Verschmierungsartefakts. Ich zeige, dass der Vorwurf nicht sticht. Er beruht auf einem Missverständnis der Schlussmethode Libets. Laut meiner wissenschaftstheoretischen Rekonstruktion zieht Libet weder deduktive noch induktive Schlüsse aus seinen Einzelbeobachtungen; er schließt abduktiv, d.h. er schließt auf die beste Erklärung seiner Einzelbeobachtungen. Wie eine genaue arithmetische Analyse zeigt, bieten die Alternativ-Erklärungen, unter denen sich das Verschmierungsartefakt bewahrheiten würde, schlechtere Erklärungen als Libets Erklärung – sie sind an den Haaren herbeigezogen und extrem unwahrscheinlich. Um 1840 hatten präzise Messungen von Fixsternentfernungen erste gedankliche Landepunkte im Weltraum geliefert. Von diesen ausgehend reflektierte der Astronomieliebhaber und Jurist Felix Eberty (1812-1884), inwiefern die Erde von den Lichtjahre entfernten Fixsternen aus betrachtet in jeweils verschiedenen Stadien ihrer Vergangenheit zu sehen sein würde. Seine Überlegungen umriss er in einer schmalen Broschüre mit dem Titel "Die Gestirne und die Weltgeschichte. Gedanken über Raum, Zeit und Ewigkeit". Ebertys Beschreibung eines zeitlich zerdehnten Weltanschauungsbildes fand in Raubdrucken und Plagiaten weltweite Verbreitung und hinterließ (...) in verschiedensten wissenschaftlich-fiktionalen Bereichen prägende Spuren, zum Beispiel in Einsteins Relativitätstheorie, der theoretischen Biologie Uexkülls und von Baers, im kosmogonischen Irrationalismus Klages', in der Geschichtsphilosophie Benjamins sowie im Kino der zwanziger Jahre. In seiner kleinen Schrift hat Eberty nicht nur neuartige denkmögliche Lichtbildlesarten beschrieben, sondern auch bereits wesentliche Züge einer zukünftigen Bildwissenschaft und Kinotheorie entworfen. Der vorliegende Band macht die Originalschriften Ebertys sowohl in der deutschen als auch in der intensiv rezipierten englischen Fassung zugänglich. Der vorangestellte Kommentar veranschaulicht die Rezeptionsgeschichte und die in das 20. Jahrhundert hineinreichende Wirkungskraft Ebertys "kosmischer Bildtheorie". (shrink)

Die Möglichkeit, Walter Benjamins Allegorie-Begriff in akademischen Untersuchungen mit der Prosa Jean Pauls in Verbindung zu bringen, wurde von Benjamin noch selbst abgewogen: in der Rezension einer frühen Abhandlung zu diesem Thema, die er für zu kurz gegriffen befand. Ein solches Vorhaben, das beste Chancen böte, dürfe sich nämlich nicht auf literaturwissenschaftliche und geistesgeschichtliche Perspektiven beschränken. Notwendig sei vielmehr, auch die Dimension der Alltagskultur einzubeziehen und Jean Pauls Hinabgreifen in Tiefen des Volkstums und der Tradition zu berücksichtigen. Diesem Hinweis (...) Benjamins folgt die vorliegende Untersuchung. Indem sie sich auf den Bereich der materiellen Kultur konzentriert, legt sie eine Geschichte der Theorie der Dingwelt offen. Jean Pauls ästhetische Überlegungen zur projektiven Belehnung der Dingwelt mit seelischen Regungen wurden von Aby Warburg aufgegriffen und für seine kulturwissenschaftliche Methode fruchtbar gemacht. Dabei erschliesst er unter anderem einen Traditionsstrang des Denkens von materieller Kultur im ästhetischen und kultur anthropologischen Kontext, der geprägt ist von aus der Antike herrührenden abergläubischen Vorstellungen über die Einflüsse der Planeten auf die menschliche Geistesverfassung wie etwa die Saturnfürchtigkeit. 'Lebendiges Judentum', schreibt Walter Benjamin 1930 an Gershom Scholem, 'habe ich in durchaus keiner anderen Gestalt kennengelernt als in dir.' Scholem, Historiker der Kabbala, früher Zionist, scharfer Kritiker der jüdischen Assimilation, Freund und Herausgeber Benjamins ist eine schillernde Gestalt und Autor faszinierender Texte. Die in den letzten Jahren veröffentlichten Jugendtagebücher und -briefe geben Einsicht in die Entwicklung des jungen Scholem und die Werkstatt seines Schreibens. Nach heftigen persönlichen Krisen und vehementen Auseinandersetzungen mit seinen Mitzionisten lernt Scholem, 'im Namen' des (...) Judentums zu sprechen. Er eignet sich die jüdische Überlieferung an und entwirft eine Philosophie und Theologie des 'Kommentars'. Als Historiker der Kabbala macht Scholem die verschlossene Welt mystischer Texte durch eine dynamische Lektüre zum Kraftfeld jüdischer Identität. Der Band führt einen jungen Intellektuellen auf der Suche nach sich und dem Judentum vor, er untersucht die Verflechtung von politischen, theologischen und wissenschaftlichen Schriften und leuchtet deren intellektual-geschichtliche Kontexte aus. “Sophisticated” theories of welfare face two potentially devastating criticisms. They are based upon two claims: that theories of welfare should be tested for what they imply about newborn infants and that even if a theory of welfare is intended to apply only to adults, we might still have sufficient reason to reject it because it implies an implausible divergence between adult and neonatal welfare. It has been argued we ought reject sophisticated theories of welfare because they have significantly counterintuitive implications (...) about neonatal welfare and because they imply an implausible divergence between the welfare of adults and that of newborns. When recalling autobiographical memories, individuals often experience visual images associated with the event. These images can be constructed from two different perspectives: first person, in which the event is visualized from the viewpoint experienced at encoding, or third person, in which the event is visualized from an external vantage point. Using a novel technique to measure visual perspective, we examined where the external vantage point is situated in third-person images. Individuals in two studies were asked to recall either 10 or (...) 15 events from their lives and describe the perspectives they experienced. Wide variation in spatial locations was observed within third-person perspectives, with the location of these perspectives relating to the event being recalled. Results suggest remembering from an external viewpoint may be more common than previous studies have demonstrated. (shrink)

That dominant school of thought envisioned the world as empty, value-free matter, on which humans impose meaning. This outlook treated statements such as “this is good” as mere expressions of feeling or preference, reflecting no objective standards. It emphasized human freedom and demanded an unflinching recognition of the value-free world. The four friends diagnosed this moral philosophy as an impoverishing intellectual fad. This style of thought, they believed, obscured the realities of human nature and left people without the resources to make difficult moral choices or to confront evil. As an alternative, the women proposed a naturalistic ethics, reviving a line of thought running through Plato, Aristotle, and Aquinas, and enriched by modern biologists like Jane Goodall and Charles Darwin. Hardly anyone disputes that discrimination can be a grave moral wrong. Yet this consensus masks fundamental disagreements about what makes something discrimination, as well as precisely why acts of discrimination are wrong. Benjamin Eidelson develops systematic answers to those two questions. He claims that discrimination is a form of differential treatment distinguished by its special connection to the differential ascription of some property to different people, and goes on to argue that what makes some cases of discrimination intrinsically wrongful (...) is that they manifest an attitude of disrespect for the personhood of those who are disfavored. He endeavors to specify what this attitude consists in, and to demonstrate how attending to its character can help us to better understand the moral dimensions of different forms of wrongful discrimination. Origin of the German Trauerspiel was Walter Benjamin's first full, historically oriented analysis of modernity. Readers of English know it as "The Origin of German Tragic Drama," but in fact the subject is something else--the play of mourning. Howard Eiland's completely new English translation, the first since 1977, is closer to the German text and more consistent with Benjamin's philosophical idiom. Focusing on the extravagant seventeenth-century theatrical genre of the trauerspiel, precursor of the opera, Benjamin identifies allegory (...) as the constitutive trope of the Baroque and of modernity itself. Allegorical perception bespeaks a world of mutability and equivocation, a melancholy sense of eternal transience without access to the transcendentals of the medieval mystery plays--though no less haunted and bedeviled. Invasive neurotechnologies are a frequent subject of discussion in neuroethics. Technologies, like deep brain stimulation and implantable brain-computer interfaces, are thought to hold significant promise for human health and well-being, but they also raise important ethical questions about autonomy, safety, stigma, privacy, and agency, among others. The terms ‘invasive’ and ‘invasiveness’ are commonly applied to these and other neurotechnologies, yet the concept of invasiveness itself is rarely defined or delimited. Some have suggested that invasiveness may have multiple meanings – physical, (...) emotional, or lifestyle – and that confusion about how people use the terms may lead to harm, especially for users of invasive devices. It is uncertain if debates in neuroethics contribute to this confusion. To investigate this, we conducted a study of how the term ‘invasiveness’ is used in neuroethics. We found that neuroethicists almost always use ‘invasiveness’ to refer to the physical features of interventions, and rarely to refer to other senses of invasiveness. We also found that referencing invasiveness does not determine which ethical issues are prioritized for a given type of neurotechnology. Overall, this study affirms the importance of understanding the meaning and use of the concept of invasiveness in ethical discussion of neurotechnology while also suggesting the need for further work in the area and consideration for rethinking what forms of technology we consider to be invasive. Regulation must target the financial sector, which often funds and profits from environmentally unsustainable development. In an era of global financial markets, the financial sector has a crucial impact on the state of the environment. The long-standing movement for ethically and socially responsible investment (SRI) has recently begun to advocate environmental standards for financiers. While this movement is gaining more adherents, it has increasingly justified responsible financing as a path to be prosperous, rather than virtuous. This trend partly owes to (...) how financial institutions view their legal responsibilities. The business case motivations that now predominantly drive SRI are not sufficient to make the financial sector a means to sustainable development. Some modest legal reforms to improve the quality and extent of SRI have yet to make a tangible difference. A more ambitious strategy to promote SRI for environmental sustainability is possible, based on reforming the fiduciary duties of financial institutions. Such duties, tied to concrete performance standards, could make financiers invest in more ethically responsible ways. Other collateral reforms to financial markets, including improved corporate environmental reporting, are required to promote sustainability. (shrink)

In the face of mounting criticism against advance directives, we describe how a novel, computer-based decision aid addresses some of these important concerns. This decision aid, Making Your Wishes Known: Planning Your Medical Future , translates an individual's values and goals into a meaningful advance directive that explicitly reflects their healthcare wishes and outlines a plan for how they wish to be treated. It does this by (1) educating users about advance care planning; (2) helping individuals identify, clarify, and prioritize (...) factors that influence their decision-making about future medical conditions; (3) explaining common end-of-life medical conditions and life-sustaining treatment; (4) helping users articulate a coherent set of wishes with regard to advance care planning—in the form of an advance directive readily interpretable by physicians; and (5) helping individuals both choose a spokesperson, and prepare to engage family, friends, and health care providers in discussions about advance care planning. We investigated the understanding of causal systems categories—categories defined by common causal structure rather than by common domain content—among college students. We asked students who were either novices or experts in the physical sciences to sort descriptions of real-world phenomena that varied in their causal structure (e.g., negative feedback vs. causal chain) and in their content domain (e.g., economics vs. biology). Our hypothesis was that there would be a shift from domain-based sorting to causal sorting with increasing expertise in the (...) relevant domains. This prediction was borne out: The novice groups sorted primarily by domain and the expert group sorted by causal category. These results suggest that science training facilitates insight about causal structures. (shrink)

Recent work on consequentialism has revealed it to be more flexible than previously thought. Consequentialists have shown how their theory can accommodate certain features with which it has long been considered incompatible, such as agent-centered constraints. This flexibility is usually thought to work in consequentialism’s favor. I want to cast doubt on this assumption. I begin by putting forward the strongest statement of consequentialism’s flexibility: the claim that, whatever set of intuitions the best nonconsequentialist theory accommodates, we can construct a (...) consequentialist theory that can do the same while still retaining whatever is compelling about consequentialism. I argue that if this is true then most likely the non-consequentialist theory with which we started will turn out to have that same compelling feature. So while this extreme flexibility, if indeed consequentialism has it (a question I leave to the side), makes consequentialism more appealing, it makes non-consequentialism more appealing too. Most conceptions of human rights rely on metaphysical or theological assumptions that construe them as possible only as something imposed from outside existing communities. Most people, in other words, presume that human rights come from nature, God, or the United Nations. This book argues that reliance on such putative sources actually undermines human rights. Benjamin Gregg envisions an alternative; he sees human rights as locally developed, freely embraced, and indigenously valid. Human rights, he posits, can be created by the (...) average, ordinary people to whom they are addressed, and that they are valid only if embraced by those to whom they would apply. Recently, extremist ‘populist’ parties have succeeded in obtaining large enough democratic electoral mandates both to legally make substantive changes to the law and constitution and to legally eliminate avenues to challenge their control over the government. Extremists place committed liberal democrats in an awkward position as they work to legally revolutionize their constitutions and turn them into ‘illiberal democracies’. This article analyses political responses to this problem. It argues that the twin phenomena of legal revolution and illiberal democracy reveal a (...) latent tension between the constitutional commitments to democracy and liberalism, that is, the equal chance to have one’s political goals enacted into law and individual basic rights. Political extremists make the latent tension real when they use the procedures of democratic legal change to abrogate constitutional commitments to liberalism, among other things. Although the two commitments normally coexist side by side, exceptional times raise an existential dilemma for liberal democracies: is it constitutional to democratically amend liberalism out of the constitution? After analysing the moral legitimacy of both the democratic and liberal arguments, this article concludes that liberal constitutionalism is constitutive of genuine democracy. In other words, it is unconstitutional to abrogate basic liberal commitments and it is legitimate to adopt constitutional mechanisms to guarantee liberalism – even if it means constraining democracy to do so. This article then situates ‘constrained democracy’ within the liberal current as a way to conceive of and respond to this pressing problem. It concludes by discussing four constitutional mechanisms – inspired by the German Grundgesetz – to guarantee liberalism: unambiguous lexically prior commitment to liberalism, limits on negative majorities, the eternity clause and party bans. It concludes that constrained democracy is an important constitutional guarantee of liberal democracy and that the four mechanisms, among others, are essential to enact constrained democracy. (shrink)
